Dallas to Sue Property Owner for Serious Code Violations

In response to a call made to the City of Dallas ’ 311 system, City inspectors from the Code Compliance Department and the City Attorney’s Office visited the property located at 4611 Monarch Street , Dallas , Texas , an occupied apartment complex.

Among other code violations, the inspectors found many units with partial electrical service, capable of supporting only lighting. In addition, large amounts of raw sewage were found in the electrical room and running down a driveway into the yard of a neighboring single family property.

An apartment property employee admitted to a City inspector that these conditions have existed at the property since Wednesday, November 22, 2006.

Because very little improvement has been made, the City Attorney’s Office has contacted the manager and the property owner and has informed both that the City will be filing a lawsuit tomorrow (Wednesday, November 29), seeking injunctive relief, including a temporary restraining order, and civil penalties of at least $1,000 per violation per day should the electricity and sewage issues not be remedied immediately.
